Restraining Orders
People are surprised to find out just how easy it is to obtain a Temporary Restraining Order. A restraining order is commonly sought when there is evidence of harassment or abuse. If substantial grounds exist for the issuance of a Temporary Restraining Order the Court will then schedule an Injunction Hearing. At an Injunction Hearing the Judge listens to evidence as to why the Temporary Restraining Order should or should not be made permanent.
In order for the Injunction hearing to proceed there must be valid personal service onto the perpetrator of the alleged action(s). If there is valid service the case proceeds to the injunction hearing.
Without adequate counsel you could end up facing consequences that may affect your parental rights, impact your ability to legally carry a gun, or even be arrested for the smallest of violations such as a text or a phone call. On the other hand, with competent representation you could successfully defend against false accusations and have the restraining order dismissed. Additionally, if you are the individual that is seeking the restraining order having proper representation could be the difference between the Judge granting the injunction or dismissing your case.
